Welcome to Upesu, the app discovery platform accessed at upesu.com and related services (the â€œPlatformâ€). By accessing or using the Platform, you agree to be bound by these Terms of Service (the â€œTermsâ€) and our Privacy Policy. If you do not agree to these Terms, please refrain from using the Platform. Your continued use after any changes to these Terms constitutes your acceptance of those changes.

2. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and note the modification date. Your continued use of the Platform after the changes take effect constitutes your binding acceptance of the revised Terms.

3. Intellectual Property

All content and materials on the Upesu Platform, including the site design, logos, graphics, text, images, and underlying software, are owned by Upesu or its licensors and are protected by applicable intellectual property laws. You may access and view content for personal, non-commercial purposes in connection with the Platform, provided you maintain all proprietary notices and do not reproduce, modify, distribute, create derivative works of, or exploit such content for commercial purposes without Upesuâ€™s prior written consent.

For content you submit to Upesu (such as reviews or comments), you grant Upesu a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute such content as necessary to operate and improve the Platform. You retain ownership of your content and are responsible for ensuring you have the right to post it.

4. Third-Party Links and Apps

Upesu functions as a discovery platform and provides links to apps listed on Google Play. The apps themselves are hosted by Google Play and other third-party stores; Upesu does not host, maintain, or control the app binaries or the stores themselves. Third-party terms, policies, and privacy practices apply to those apps and stores. Upesu does not endorse, warrant, or assume responsibility for any third-party content, services, or products, and your use of linked apps is at your own risk.

5. Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, UPESU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. UPESU DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ADVICE OR INFORMATION OBTAINED FROM UPESU OR THROUGH THE PLATFORM CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPESU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM. IN NO EVENT SHALL UPESU'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE PLATFORM EXCEED THE GREATER OF USD 100 OR THE AMOUNT PAID, IF ANY, BY YOU FOR ACCESS TO THE PLATFORM.

7. Indemnification

You agree to defend, indemnify, and hold Upesu and its officers, directors, employees, and affiliates harmless from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneysâ€™ fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any rights of a third party.

8. Termination

We may suspend or terminate your access to the Platform at our sole discretion, at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately, and you must remove any Downstream Content obtained through the Platform from your devices, if applicable.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which Upesu is incorporated, without regard to its conflict of laws principles. Any disputes arising under or in connection with these Terms shall be resolved in the courts located in that jurisdiction.
